Jammu, Oct 7: A Special NIA Court in Jammu has declared a wanted terror accused, believed to be hiding in Pakistan, a proclaimed offender following an application by the National Investigation Agency (NIA).
The accused, Nazir Hussain, a resident of Hari village in Poonch district, is wanted in a terror conspiracy case being investigated by the NIA after the recovery of several grenades from an alleged overground worker in the Surankote area in October 2024.
The investigation revealed that the grenade consignment was allegedly sent from across the border by Hussain, who is also known by aliases including Ali Khan, Nasir, Naziru and Shaheen, with the alleged intention of carrying out blasts.
Special Judge (NIA), Jammu, Prem Sagar, declared Hussain a proclaimed offender under Section 84 of the Bharatiya Citizen Security Code (BNSS) after hearing the NIA plea on October 1.
According to the court order, non-bailable warrants had earlier been issued against the accused. However, the warrants could not be executed as he was not found at his residence. The execution report submitted by the NIA stated that Hussain had absconded to Pakistan.
The court observed that despite efforts by the prosecution, including publication of notices in newspapers and the official Gazette of Jammu and Kashmir, the accused neither appeared before the court nor surrendered.
The court concluded that the accused had deliberately evaded arrest, leading to his declaration as a proclaimed offender. (Agencies)
